Anti-spam and anti-virus protection service

This service order (SO) forms an integral and substantial part of the general service conditions (GSC). The GSC and SO lay down the terms and conditions for the supply of the protection service against spam and viruses (Anti-spam and Anti-virus Service) by Amen to the customer.

 

1 – Description of the anti-spam and anti-virus service

The Anti-spam and Anti-virus Service consists of the supply by Amen of protection against spam and viruses in the POP3 or IMAP mailbox operating on an active domain registered with Amen and resident in the Amen mail server. The term spam refers to the transmission of one or more messages containing unsolicited documents which may or may not have attachments. The term virus refers to a parasite programme written intentionally to modify the normal operation of the computer, which is sent to the user without his knowledge.

Anti-spam protection automatically filters the spam sent to the customer’s mailbox by installing the anti-spam software on the Amen mail server checking common words, html tags and the repetitive nature of the mail sent as keys for the analysis of incoming mail. For emails classified on the basis of the percentage of probability that they are spam the customer may decide how to proceed (e.g.: deleting them, moving them into the spam folder and so on). Anti-virus protection automatically filters the viruses sent to the customer’s mailbox by installing a dedicated software developed to identify several types of virus, worms and Trojans. The anti-virus software analyses the incoming emails and the attached files, which are the main conveyors of potentially infecting viruses. If a virus is identified, the customer may decide how to proceed (e.g.: deleting them, moving them into the trash folder and so on).

 

2 – Conditions for the supply of the anti-spam and anti-virus service

The anti-spam and anti-virus service is supplied by Amen only and exclusively under the following conditions:
– existence of customer domain name kept by Amen as maintainer, registrar or reseller.
– eexistence of a mailbox associated with the customer domain name kept by Amen as maintainer, registrar or reseller.
– for the entire duration of the anti-spam and anti-virus service, use of the DNS authorising domain name of Amen. The customer declares his awareness of the fact that the use of an authorising DNS other than that of Amen will make it impossible to use the mail service, which will become available again only following reconfiguration of the Amen authorising DNS;
– standard configuration of the MX and POP 3 records (or the mail server of Amen).

The anti-spam and anti-virus service may be used exclusively as an additional service to the mailbox active in the domain kept by Amen. The customer declares his awareness that failure to comply with one or more of the conditions set out above will make it impossible to use the anti-spam and anti-virus service. The customer is therefore informed that if at any time during the period of validity of this contract he fails to renew the domain name or transfers it to another Maintainer or configures the domain name on authorising DNS other that of Amen or changes the configuration of the MX record, the anti-spam and anti-virus service will become technically impossible for Amen to provide and the contract will therefore be terminated immediately, without affecting the right to receive full payment of the subscription and the right of Amen to press claims for full compensation of any damage suffered.

 

3. – Regulations for use

The anti-spam and anti-virus service consists of the automatic filtering of the spam sent to the customer’s mailbox by means of a centralised installation of the anti-spam and anti-virus software in the Amen mail server. Amen will supply the updated version of the software on a continuous basis. The customer has been informed and is aware of the fact that the base settings of the anti-spam and anti-virus service will be laid down by Amen. By means of his control panel, the customer may set a number of filtering rules as indicated in paragraph 1 of this service order. Amen, will in any case be free to modify the base settings in any way and at any time, to ensure the most effective provision of the service at all times. The customer has also been informed and is aware that the email messages defined as spam will be inserted in special file folders that can be checked by the customer. The customer will be responsible for cancelling these emails to avoid saturation of the space made available. The adoption of the anti-spam and anti-virus service requires no modification to the configuration of the customers email clients (Outlook, Outlook Express, Mozilla Thunderbird, Mail and so on). Nothing is changed or reset, as the undesirable message filtering operation takes place at the level of the server, and consequently upstream of the email operating environment. In any case, Amen declares and the customer acknowledges that Amen cannot in any way guarantee that the customer will receive no undesirable email messages or that he will receive all the desired messages, even though the greatest possible diligence will be applied to ensure the most effective performance of the service.

The customer agrees not to use the service covered by this service order as an addition to the email service for illicit purposes, will comply with the regulations for use and will in no way violate the national and international legislation and regulations that apply. The customer also agrees to follow the rules of Netiquette available on http://www.nic.it/NA/netiquette.txt.
Amen reserves the right to suspend the service immediately if, upon its own judgement or as a result of information received from third parties, it believes that the customer is using the service to violate the obligations contained in this article. In such a case, after being notified by email by Amen, the customer will immediately remove the causes of the suspension and forward relevant documentation proving that his activities are in full compliance with the regulations in force. In the event of failure to reply, Amen will have the right to terminate the contract immediately, and will retain the right to full payment for the service and press claims for full compensation for any damages suffered.

 

4 – Term

As decided by the Customer during the purchase procedure or afterwards, from his toolbar, this SO may expire a) with or b) without tacit renewal.
a) In the case of expiration with tacit renewal and credit card payment, the consideration set forth in the following article “Consideration and Payments” will be billed directly by Amen to the Customer’s credit card, in accordance with the terms and conditions in effect at the time of renewal, as illustrated on the toolbar following notification via e-mail. If Amen cannot bill this charge, the agreement cannot be tacitly renewed and will be considered definitively expired at the envisaged expiration date. In this case, the Customer may renew the service by following the procedure described hereunder at . In the case of expiration with tacit renewal and payment with a system other than credit card, 20 days before the expiration date Amen will execute the renewal and send the invoice to the Customer. This invoice must be paid in accordance with the terms set forth therein. The invoice and payment instructions will be sent via surface mail to the address recorded in Amen files at the time of the order. If the Customer does not make payment by the envisaged deadline, Amen may interrupt the service at any time, except as envisaged in Article 6 of the General Conditions of Service.
b) In the event of expiration without tacit renewal, the Customer may request that Amen, through the online procedure provided by Amen, to renew the service with this SO for additional, subsequent periods by the deadlines appearing on the Customer’s toolbar and at the technical and economic conditions in effect when the service is renewed, executing the renewal procedure. If it is not renewed in the forms and by the deadlines indicated above, when this SO expires, it will lawfully cease to have any effect, without it being necessary for Amen to send any further notices.

 

5 – Consideration and payments

The Consideration for the anti-spam and anti-virus service is that indicated in the offer. Any Consideration is to be intended net of VAT, unless otherwise specified.
The payment of the consideration for the anti-spam and anti-virus service shall be made by credit card, filling in the payment form during the registration procedure.
